Copyright Infringement occurs when someone uses copyrighted material without the proper authorization. This may include using music, artwork, another artist’s name or likeness, or other protected intellectual property. At Too Lost, we are committed to protecting the rights of creators, which is why we take copyright infringement very seriously.
How Copyright Infringements Are Handled Through Too Lost
- Notification of Copyright Infringement: If a copyright infringement has been reported on your account, you will receive a notice at the email address associated with your account. This email will provide details on the issue and any actions taken. In most instances you will need to resolve the claim directly with the claimant. Please note their contact information and let us know when you reach a resolution.
- Account Restrictions: Accounts flagged for copyright infringements will have certain features restricted. These restrictions may include a hold on payouts, the ability to create new releases, or both. These restrictions will remain in place until the infringement claim(s) is resolved. Too Lost might take down the content from other stores while the claim is pending.
- Content Takedowns: Content flagged for copyright infringement is taken down by the store or platform directly, not by Too Lost. If you believe the takedown was an error, you’ll need to address this with the claimant who initiated the copyright claim. Only the claimant can authorize the reinstatement of your content with the store or platform directly.
- Resolution: To resolve your claim, we ask you to reach out to the claimant with the contact information provided to you. Once they retract the claim with the store directly, you can create a support ticket informing of this resolution. We recommend attaching screenshots or providing further clarification to show that this has been resolved.
- Proof of Ownership: In certain circumstances, we may ask you to provide proof of ownership of the content that should demonstrate you have the authority to distribute the release that we may pass along to the DSPs. Valid documentation would include agreements signed by all collaborators, copyright registration or publishing documentation, producer or studio agreements, and/or, any other evidence showing your role in creating, owning, or licensing the content.
- Too Lost’s Limited Role: To maintain strong relationships with our distribution partners, we handle copyright issues with strict adherence to legal guidelines and partner policies. Because of this, our ability to assist with specific copyright disputes is limited.
If you have further questions about your account’s status or general copyright policies, please reach out to our Support team for further clarification. Please note that Too Lost cannot provide legal advice. If you are unsure about how to resolve your claim with the claimant, consult an attorney.
